These terms govern your access to and use of HeliWX (the app, the website and the reports, alerts and emails it produces — together, "the service"). By using the service, or by creating an account, you accept these terms. If you do not agree with them, do not use the service.

1. Operator

The service is operated by [Company name, S.L.], a company incorporated in Spain, tax ID (CIF) [•], with registered office at [address], Spain, registered in the Mercantile Registry of [city] (the "operator", "we"). Contact: contact@heliwx.app.

2. The service

HeliWX is a software-as-a-service weather briefing tool for helicopter operations. It aggregates publicly available aeronautical weather and information (such as METAR, TAF and NOTAM), compares it against minima you configure, and presents the result in the app and in PDF reports, scheduled emails and alerts. Some features require an account and, depending on your plan, a paid subscription.

3. Operational disclaimer

HeliWX is a decision-support tool only. It is not an official source of aeronautical information and does not replace an official pre-flight briefing. Weather and aeronautical data are provided "as is", without warranty of any kind, and may be delayed, incomplete or inaccurate. The operator's approved manuals, procedures, minima and current official aeronautical information remain the sole authoritative reference, and the pilot-in-command remains solely responsible for all operational decisions.

4. Your account

You must provide accurate information when creating an account, keep your credentials confidential, and are responsible for all activity under your account. An account is personal and may not be shared, except through the multi-user features the service itself provides. We may suspend or close an account that breaches these terms.

5. Plans, billing and cancellation

Paid plans are billed as subscriptions through our payment provider, Stripe. Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current period, which remains payable. Prices and plan limits may change; changes to a paid plan will be notified before they apply to you. If you are a consumer, by starting a subscription you request immediate access to the service and acknowledge that, once the digital service has been fully provided during the billing period, the statutory right of withdrawal is exercised as provided by Spanish and EU consumer law. Nothing in these terms limits your statutory consumer rights.

6. Acceptable use

You agree not to misuse the service: no unlawful use, no attempts to disrupt or gain unauthorised access to it, no automated scraping or bulk extraction of its data, and no reselling or redistributing the service or its output as your own service without our written agreement.

7. Availability and changes to the service

We aim to keep the service available and accurate, but we do not guarantee uninterrupted or error-free operation, and third-party data sources may be unavailable at any time. We may modify, add or remove features, and may discontinue the service with reasonable notice. Do not rely on the service as your only means of obtaining weather or aeronautical information.

8. Intellectual property

The service, its software, design, branding and content (other than the public aeronautical data it displays and the settings you create) belong to the operator or its licensors. Your subscription grants you a personal, non-exclusive, non-transferable right to use the service; it does not transfer any intellectual property rights.

9. Liability

The service is provided "as is" and "as available". To the maximum extent permitted by applicable law, the operator excludes all warranties and shall not be liable for any loss or damage arising from the use of, or reliance on, the service, including operational decisions made with it, and its total liability for any claim shall not exceed the amounts you paid for the service in the twelve months preceding the claim. Nothing in these terms excludes or limits liability that cannot be excluded under Spanish law, including liability for wilful misconduct or gross negligence.

10. Data protection

Personal data is processed in accordance with the EU General Data Protection Regulation and Spanish data-protection law, as described in our Privacy & Cookies policy.

11. Changes to these terms

We may update these terms. Material changes will be announced in the app or by email before they take effect; the "Last updated" date above reflects the current version. Continued use of the service after a change takes effect constitutes acceptance of the updated terms.

12. Governing law and jurisdiction

These terms are governed by Spanish law. Disputes are subject to the courts of [city], Spain, except where you are a consumer, in which case the courts of your place of residence remain competent and your mandatory consumer protections apply. Consumers in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.
